Action Description Probation for three years with conditions. The following conditions are permanent and take effect thirty days after the effective date of this order: the physician shall with each patient encounter communicate the following to the patient/patient proxy; the nature of her role whether as a primary care physician or consultant and that the treatment modalities recommended by her are not universally accepted treatment modalities for a specific applied use; obtain written informed consent that specifically addresses the treatment, risks, benefits and financial responsibility of the patient/patient proxy and fully document this information in the patient record; obtain the patient’s written consent to request medical records from prior or concurrent health care providers and shall document such referral, review or refusal of such records. The physician must note any and all indications for all diagnostic tests and lab work ordered; must obtain the results and perform proper follow-up and communicate the results to those involved in the patient’s care and treatment. The physician shall refer the patient to an appropriate provider where medically warranted and beyond her scope or role and note such referrals as well as refusal. Hyperbaric Oxygen Therapy (HBOT) referrals must be to an accredited facility only, and if she is providing the HBOT herself or under a PC or with portable Hyperbaric tanks, the facility shall be accredited and meet or exceed Federal safety specifications. These conditions shall take effect thirty days after the effective date of this order unless an extension is granted by the OPMC. During probation the physician may only practice medicine when monitored by a licensed physician, board certified in an appropriate specialty who is familiar with the diagnostic and treatment modalities practiced and offered by the physician and must successfully complete a CME program subject to the approval of the Director of OPMC.
Misconduct Description The physician asserted she could not successfully defend against at least one of the charges of misconduct alleged by practicing the profession of medicine with negligence on more than one occasion and failing to maintain accurate medical records.
